The focus is on the moral, legal, and political questions that arise when individuals who commit collective crimes, such as crimes against humanity, are held accountable by international criminal tribunals. Cognitive science is transforming our understanding of the mind. New discoveries are changing how we comprehend not just language, but thought itself. Yet, surprisingly little of the new learning has penetrated discussions and analysis of the most important social institution affecting our lives-the law. The sound system of a language must be able to support a perceptual contrast between different words in order to signal communicatively relevant meaning distinctions. In this paper, we use a simple agent-based exemplar model in which the evolution of sound-category systems is understood as a co-evolutionary process, where the range of variation within sound categories is constrained by functional pressure to keep different words perceptually distinct. We show that this model can reproduce several observed effects on the range of (...) sound variation. We argue that phonological systems can be seen as finding a relative optimum of variation: Efficient communication is sustained while at the same time, hidden category variation provides pathways for future evolution. In the last two decades there has been a meteoric rise of international criminal tribunals and courts and also a strengthening chorus of critics against them. Today it is hard to find strong defenders of international criminal tribunals and courts. This book attempts such a defense against an array of critics. It offers a nuanced defense, accepting many criticisms but arguing that the idea of international criminal tribunals can be defended as providing the fairest way to deal with mass atrocity (...) crimes in a global arena. Fairness and moral legitimacy will be at the heart of this defense. The authors take up the economic and political arguments that have been powerfully expressed, as well as arguments about sovereignty, punishment, responsibility, and evidence; but in the end they show that these arguments do not defeat the idea of international criminal courts and tribunals. In his Florentine Histories, Machiavelli offers an ambivalent portrayal of the revolt of the textile workers in late fourteenth-century Florence, known as the tumult of the Ciompi. On the face of it, Machiavelli's depiction of the insurgent workers is not exactly flattering. Yet this picture is undermined by a firebrand speech, which Machiavelli invents and attributes to an unnamed leader of the plebeian revolt. I interpret this speech as a radical and egalitarian vector of thought opened up by Machiavelli's text. (...) The revolutionary address reveals an untimely and not entirely self-conscious political radicalism, a plebeian politics that repudiates the logic of oligarchic privilege and is simultaneously not available for subsumption under the mantle of civic republicanism. In the moral realm, our deontic judgments are usually (always?) binary. An act (or omission) is either morally forbidden or morally permissible. 1 Yet the determination of an act's deontic status frequently turns on the existence of properties that are matters of degree. In what follows I shall give several examples of binary moral judgments that turn on scalar properties, and I shall claim that these examples should puzzle us. How can the existence of a property to a specific degree (...) demarcate a boundary between an act's being morally forbidden and its not being morally forbidden? Why aren't our moral judgments of acts scalar in the way that the properties on which those judgments are based are scalar, so that acts, like states of affairs, can be morally better or worse rather than right or wrong? I conceive of this inquiry as operating primarily within the realm of normative theory. Presumably it will give aid and comfort to consequentialists, who have no trouble mapping their binary categories onto scalar properties. For example, a straightforward act utilitarian, for whom one act out of all possible acts is morally required (and hence permissible) and all others morally forbidden, can, in theory at least, provide an answer to every one of the puzzles I raise. And, in theory, so can all other types of act and rule consequentialists. They will find nothing of interest here beyond embarrassment for their deontological adversaries. The deontologists, however, must meet the challenges of these puzzles. And for them, the puzzles may raise not just normative questions, but questions of moral epistemology and moral ontology. Just how do we know that the act consequentialist's way of, say, trading off lives against lives is wrong? For example, do we merely intuit that taking one innocent, uninvolved person's life to save two others is wrong? Can our method of reflective equilibrium work if we have no theory by which to rationalize our intuitions? And what things in the world make it true, if it is true, that one may not make the act consequentialist's tradeoff? I do not provide any answers to these questions any more than I provide answers to the normative ones. But they surely lurk in the background. (shrink)

This essay, as will become obvious, owes a huge debt to Mark Kelman, particularly to his article “Interpretative Construction in the Substantive Criminal Law.” That debt is one of both concept and content. There is rich irony in my aping Kelman's deconstructionist enterprise, for I do not share his enthusiasm for either the “insights” or the political agenda of the Critical Legal Studies movement. I do not believe that either the law in general or the criminal law in particular is (...) radically indeterminate, rife with internal contradictions, or an expression of the interests of a dominant economic class. And although, like Kelman, I believe that the freedom/determinism, act/character, and rule/principle dichotomies must ultimately be dealt with in order to have a completely satisfactory account of criminal law, I also believe that these dichotomies loom just as large in other areas of law and in normative theory generally. They are problems for Crits as well as for liberal-legalists. In any event, my intentions in undertaking this deconstructionist enterprise are modestly reformist, not revolutionary. I do not intend to shift any paradigms, but to work with well-established ones. I will assume that criminal law seeks to accomplish some blend of retributive response to and deterrence of culpable choices, choices to defy moral norms that are also legal norms. I will also assume that a culpable choice is one that reflects negatively on the values held by the chooser. Beyond these quite modest assumptions, I need not and will not venture in this paper, realizing, of course, that much has and can be written about the proper aims of punishment and the proper account of culpability. Although discussions of John Rawls’ A Theory of Justice generally refer to Rawls’ two principles of justice, and although Rawls himself labels his principles “the two principles of justice”, Rawls actually sets forth three distinct principles in the following lexical order: the liberty principle, the fair equality of opportunity principle, and the difference principle. Rawls argues at some length for the priority of the liberty principle over the other two. On the other hand, Rawls offers hardly any argument at all (...) for the priority of the fair equality of opportunity principle over the difference principle. In this article I will argue that making the fair equality of opportunity principle separate from and lexically prior to the difference principle is both intuitively unattractive and inconsistent with Rawls’ method of deriving principles of justice from the choices of rational contractors in the original position. Christian Scientists' refusal of medical care for their children illustrates the kind of conflict over moral and practical authority that can arise between groups in a pluralistic society. While consensus may not be possible, changes in the way both groups socialize members may allow the medical and Christian Science communities to achieve a compromise that is respectful to both.

The intelligent-seeming deeds of computers are what occasion philosophical debate about artificial intelligence (AI) in the first place. Since evidence of AI is not bad, arguments against seem called for. John Searle's Chinese Room Argument (1980a, 1984, 1990, 1994) is among the most famous and long-running would-be answers to the call. Surprisingly, both the original thought experiment (1980a) and Searle's later would-be formalizations of the embedding argument (1984, 1990) are quite unavailing against AI proper (claims that computers do or someday (...) will think ). Searle lately even styles it a "misunderstanding" (1994, p. 547) to think the argument was ever so directed! The Chinese room is now advertised to target Computationalism (claims that computation is what thought essentially is ) exclusively. Despite its renown, the Chinese Room Argument is totally ineffective even against this target. (shrink)

In this paper we introduce a theoretical framework and a logical application for analysing the semantics and pragmatics of contrastive conjunctions in natural language. It is shown how expressions like although, nevertheless, yet, and but are semantically definable as connectives using an operator for implication in natural language and how similar pragmatic principles affect the behaviour of both contrastive conjunctions and indicative conditionals. Following previous proposals, conditions on contrast in a conjunction are analysed as presuppositions of die conjunction. Further linguistic (...) evidence leads to a distinction between restrictive and non-restrictive connectives of contrast, and consequently between direct and indirect contrast, which are given a precise definition. A general interface for a theory of contrast using possible world semantics for implication is then presented. As a test case, we show how this interface is applicable to the semantics for conditionals that was introduced by Veltman in his article 'Data semantics and the pragmatics of indicative conditionals' (1986). This application yields an extension of Veltman's Data Logic, called Contrastive Data Logic Once appropriate modifications are added to Veltman's pragmatic considerations, we show that contrastive data logic provides an adequate tool for the analysis of substantial linguistic data concerning contrast and implication in natural language. Self-defense and other-defense are uses of force against another person—an attacker—for the purpose of preventing the attacker from harming a victim. When such force is exercised by the victim, it is self-defense; when by a third party, other-defense. Self-defense and other-defense are preemptive uses of force because they occur before the acts they are intended to prevent occur. Thus, they operate in the realm of epistemic uncertainty. Victims and third parties can never be certain the feared acts will occur. They (...) can never be certain of what their consequences will be if the acts occur. They can never be certain what alternative exists to self-defense and other-defense for averting the feared harms. And they can never be certain what the status of the presumed attacker is—that is, whether the presumed attacker is culpable or nonculpable. Such epistemic points are addressed in this chapter. We prove that every convexly ordered valuation ring has a unique completion as a uniform space, which furthermore is a convexly ordered valuation ring. In addition, we give a model theoretic characterisation of complete convexly ordered valuation rings, and give a necessary and sufficient condition for the completion of a convexly ordered valuation ring to be a real closed ring.

This chapter asks whether necessity permits attacking forces to kill rather than disable first. Section I begins by considering the specific prohibitions of the laws of war, and concludes these specific prohibitions do not add up to a more general duty to refrain from using lethal force against enemy combatants. Section II then looks at the legal prohibition regarding killing soldiers who are hors de combat, and concludes that it provides no support for a general requirement to use non-lethal force (...) first in all situations. Section III then examines the travaux preparatoires for the Additional Protocols to the Geneva Conventions and concludes that the least-harmful-means test, though by all means a subject of discussion at the Geneva conferences, was not codified into the Additional Protocols. Finally, Section IV considers the question from the perspective of normative theory and asks whether principles of moral philosophy require a change in the law. (shrink)

This chapter examines how the concept of necessity is used in Just War theory as a principle of last resort—a criterion that must be satisfied before the recourse to force can be justified. It reassesses the doctrine of anticipatory self-defense, and the larger question of the justifiability of preemptive and preventive war, from the Just War perspective. The second and third sections rehearse an important debate between Alberico Gentili and Hugo Grotius. It then looks at “first strikes” and then at (...) “last resorts” to see what, if anything, is to be said for these as markers of aggressive or defensive war. These sections address directly the justifiability of preemptive war with reference to the principle of necessity in jus ad bellum debates in Just War theory. (shrink)

This chapter discusses how jus in bello necessity can and should be balanced against the principle of humanity. In many ways, the principle of humanity covers much of the same ground as human rights principles, except in this case the principle is already internal to jus in bello. So this chapter explains how some human rights principles—under the guise of the principle of humanity—have a proper role to play in checking the inherent permissiveness of jus in bello necessity. To accomplish (...) this task, the chapter examines how the principle of humanity and necessity work in both legal and philosophical arguments about just conduct during warfare. (shrink)

This chapter asks a similar set of questions regarding necessity and the duty to capture, that is, whether necessity requires an attacking force to attempt capture prior to initiating a lethal strike. There is no such duty codified in existing legal obligations, at least not where jus in bello is concerned. However, restrictions on the use of overwhelming force might be found in a reinvigorated jus ad bellum obligation on the part of attacking forces to cease an attack when the (...) necessity giving rise to the armed conflict has evaporated because the enemy nation has been so decimated that they are incapable of constituting a national threat anymore. Finally, this chapter also asks whether it would be morally advisable to amend the codified rules of jus in bello to require non-lethal attacks in limited and carefully circumscribed contexts. The Greek words `pharmakon' and `pharmakos' allude to the complex relations between political violence and the health or disorder of the body politic. This article explores analogies of war as disease and contagion, and contrasts these with metaphors of war as politically healthy and medicinal - as in Randolph Bourne's notion of war as `the health of the state'. It then applies these to the unfolding US `War on Terrorism' through the concept of `pharmacotic war', by way of examining the (...) disturbing political implications of both unfolding US military actions abroad and the scapegoating of internal `enemies' within the United States. The article then critiques various strategies for interrupting the momentum towards a catastrophic `clash of civilizations' between the US and the Islamic world, and proposes a strategy of broadly based, grassroots political mobilization for opposing this trend.
